The Regional Electoral Court of Sao Paulo (TRE-SP) disapproved unanimously on Thursday session, the provision of PT's State Board's accounts for the financial year 2010. The court convicted, by majority vote (four three), the PT to the suspension of the quota of the Party Fund for six months. The party has yet to return R $ 632,626.69 to the public coffers.
The rapporteur of the case, Silmar Fernandes judge noted that the accounts presented "various irregularities such as uneven application of the party fund, source identification impossibility of proceeds from affiliated contribution and irregular allocation of not due funds and not accounted for."
The TRE-SP determined to return 343,355.16 reais to the Treasury, "in view of the receipt of unidentified origin of resources" and 289,271.53 reais on the irregular application of the party fund. The decision followed the TRE understanding of the Regional Electoral Attorney in São Paulo.
Among the problems identified by the Internal Control Department (SCI) of the court "are not evidence of various expenses incurred in that year, and the failure to prove the source of annual revenue for the 2010 election."
Criticism of accounts worsening the financial situation of São Paulo PT. The party is currently about 50 million, of which $ 35 million are related to debts of the failed campaign of former minister Alexandre Padilha (Health) to the state government in last year's elections - in 2010, the candidate was minister Mercadante (Casa Civil). The National Directorate party banned all instances legend to receive donations from companies. Since the end of last year the PT leadership in São Paulo renegotiates debt and tries to extend payment terms with suppliers.
The president of the Sao Paulo directory, Emidio de Souza, said the party will appeal the decision. "We learned a while ago, but we will appeal. The decision was made for purely formal reasons," said PT.
