It is difficult to obtain the operating license to the Internet



The excess of legal requirements has taken the strength of initiatives that could make life easier entrepreneur. Such is the case today with the Electronic Licensing System Activities (Slea) of the city of São Paulo, which was created to allow the entrepreneur get a license to operate and rectify your business on the Internet. In practice, however, few have been successful in using that route.

It is estimated that 70% of operating permits issued by the city could be obtained through the Slea. But only 12% of them are flushed through the system. The problem is that the city government led to the digital environment throughout the bureaucracy found in branches of public bodies.

Upon entering the electronic system, one of the first information required is the entrepreneur the risk involved in the activity he will perform. The degree of risk is information brought by the National Classification of Economic Activities (CNAE), used virtually everywhere in Brazil, but not in the city of São Paulo, which adopts the Register of CCM (taxpayers).

This discrepancy complicates the life of the taxpayer applying for the license, but also harms the inclusion of São Paulo in programs involving other institutions and federal agencies.

There is a project of the federal government, in progress to integrate the systems of the Board of Trade, Internal Revenue Service and state and local farm to allow the company to open in São Paulo is made within five days.

Without standardization by CNAE is not possible to integrate the systems, according to Wilson Poit Martins, chief executive of São Paulo Business, mixed economy company linked to the municipal Department of Economic Development. Poit cited other barriers: the Slea does not release the operating license if the trade mark has irregularities in the Occupancy Permit, which is the document which certifies that the property was built in accordance with local regulations.

Entrepreneurs who have tried using the Slea also complained that some information that should be provided by the system are not found in it. The width of the streets, for example, is not always registered in the system but is required to obtain the operating license. No way to report this information on the Internet, the entrepreneur is obliged to seek personal assistance. 

The lane width is associated with the possibility of fire trucks entry, or creation of escape routes in case of accidents. Contained in the proposed amendment to LPUOS the end of that demand for low-risk activities - spanning more than 80% of municipal companies.

During the meeting in the ACSP, Antonio Carlos Pela, CPU coordinator, noted that the demands on the entrepreneur do Sao Paulo losing competitiveness. "Many companies that could produce in Sao Paulo began to settle in Rio de Janeiro, where they found more facilities to carry out their activities," said Pella.

A survey of the World Bank to measure the competitiveness of global metropolises put St. Paul in the 120 ° position among 139 cities. One of the criteria that overthrew the state capital in this ranking was the time it takes to start a business, which is 102 days on average.
